Waste Clearance Tooting Service Terms and Conditions

These Terms and Conditions set out the basis on which Waste Clearance Tooting provides waste collection and related services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

Customer means the person, firm or company requesting services from Waste Clearance Tooting.

Services means waste clearance, rubbish removal, junk collection, recycling, bulky item collection and any related services provided by Waste Clearance Tooting.

Waste means any materials, items, goods or substances presented for removal under a booking.

Agreement means the contract between Waste Clearance Tooting and the Customer for the provision of Services, comprising these Terms and Conditions and any written confirmation of the booking.

2. Scope of Services

Waste Clearance Tooting provides waste collection and clearance services for households, landlords, letting agents, businesses and other organisations. Services may include, but are not limited to, general household waste, garden waste, office clearance waste and light construction waste where agreed in advance.

All waste collection and disposal is carried out in accordance with applicable UK waste management laws and regulations. The Customer is responsible for providing accurate information about the type, volume and nature of the waste so that a suitable service and quotation can be provided.

3. Booking Process

3.1 Bookings may be made by telephone, email or through any booking system operated by Waste Clearance Tooting. When making a booking, the Customer must provide clear and accurate information, including:

a. Full name and contact details

b. Collection address and any access information

c. Description and approximate volume of waste to be collected

d. Preferred date and time window for collection

3.2 Bookings are subject to availability. Waste Clearance Tooting will confirm acceptance of a booking by issuing a booking confirmation verbally or in writing. No Agreement is formed until a booking has been accepted and confirmed.

3.3 The Customer must inform Waste Clearance Tooting of any relevant circumstances that may affect the delivery of the Services, including restricted access, parking limitations, time restrictions or requirement for special equipment.

3.4 If on arrival the actual volume, weight or nature of the waste differs significantly from the description given at the time of booking, Waste Clearance Tooting reserves the right to revise the price, amend the service, or decline to carry out the collection in part or in full.

4. Service Area and Access

4.1 Waste Clearance Tooting operates primarily within Tooting and surrounding areas. Service availability may vary by location.

4.2 The Customer is responsible for ensuring safe, suitable and legal access for the collection vehicle and crew, including any necessary parking arrangements or permits. Any parking charges or fines incurred as a direct result of the Customer providing incorrect or incomplete information may be charged to the Customer.

4.3 Waste must be accessible at the agreed collection time. Unless otherwise agreed, collections are from the ground floor or external areas only. Additional labour charges may apply where items must be carried from upper floors or difficult-to-access areas.

5. Pricing and Quotations

5.1 Quotations are usually based on the information provided by the Customer, including the estimated volume and type of waste, access conditions and location.

5.2 All prices are provided in pounds sterling and may be subject to applicable taxes. If any tax or duty rate changes between the date of the booking and the date of the service, the price may be adjusted accordingly.

5.3 Quotations are not binding if the information supplied by the Customer is inaccurate or incomplete. If, on arrival, the waste is substantially different from the description, Waste Clearance Tooting will either provide a revised price or give the Customer the option to proceed with a reduced service corresponding to the original quotation.

6. Payments

6.1 Payment is due on completion of the collection unless otherwise agreed in writing. Waste Clearance Tooting may require full or partial payment in advance for certain services or for commercial accounts.

6.2 Accepted payment methods may include cash, debit or credit card, and bank transfer, subject to availability at the time of service. The Customer must ensure that sufficient funds are available to complete payment.

6.3 For commercial Customers with agreed credit terms, invoices must be paid within the timeframe stated on the invoice. Waste Clearance Tooting reserves the right to charge interest on overdue amounts at the statutory rate until payment is received in full.

6.4 If payment is not made when due, Waste Clearance Tooting may suspend further services, refuse to collect additional waste, and take reasonable steps to recover outstanding sums, including instructing a third-party debt collection agency. The Customer will be responsible for any reasonable costs incurred in recovering overdue amounts.

7. Cancellations and Amendments

7.1 The Customer may cancel or reschedule a booking by contacting Waste Clearance Tooting as soon as possible.

7.2 If the Customer cancels more than 24 hours before the scheduled collection time, any pre-paid amount may be refunded or credited, subject to any non-refundable costs already incurred.

7.3 If the Customer cancels less than 24 hours before the scheduled collection time, Waste Clearance Tooting reserves the right to charge a cancellation fee up to a reasonable proportion of the quoted price to cover administration, scheduling and lost opportunity costs.

7.4 Where the Customer is not present or does not provide access at the agreed time, this may be treated as a late cancellation, and a call-out or wasted journey fee may apply.

7.5 Waste Clearance Tooting may, in rare cases, need to cancel or reschedule a booking due to reasons beyond its control, including vehicle breakdown, staff illness, severe weather or access restrictions. In such cases, Waste Clearance Tooting will notify the Customer as soon as reasonably practicable and offer an alternative time or refund any pre-paid amount. No further compensation will be payable.

8. Customer Obligations

8.1 The Customer must ensure that waste presented for collection is accurately described and is suitable for manual loading by the collection crew.

8.2 Hazardous, dangerous or prohibited waste must not be presented without prior written agreement. This includes, but is not limited to, asbestos, clinical or medical waste, chemicals, solvents, oils, pressurised containers, gas bottles, explosives, radioactive materials and certain electrical items requiring specialist handling.

8.3 The Customer must separate any waste types that have been agreed as requiring separate handling, such as electrical items, mattresses or recyclables, where requested.

8.4 The Customer is responsible for ensuring that items to be removed are not required, of sentimental value, or in any way excluded from the collection. Waste Clearance Tooting cannot be held responsible for the removal of items mistakenly presented as waste.

9. Waste Regulations and Duty of Care

9.1 Waste Clearance Tooting operates in accordance with applicable UK waste legislation and guidance, including requirements relating to waste carriers, waste transfer notes and lawful disposal.

9.2 Waste will only be taken to licensed and authorised facilities for reuse, recycling, recovery or disposal, as appropriate. The Customer acknowledges and accepts that the precise destination or treatment of waste may vary depending on the type of material and relevant regulations.

9.3 Where required, Waste Clearance Tooting will complete waste transfer documentation. The Customer must provide any information reasonably requested for these purposes and may be asked to sign or acknowledge documentation confirming the transfer of control of the waste.

9.4 The Customer retains a duty of care for their waste until it is transferred to Waste Clearance Tooting in accordance with applicable regulations. By using the Services, the Customer confirms that they have complied with their obligations and are lawfully entitled to transfer the waste to Waste Clearance Tooting.

10. Liability and Limitations

10.1 Waste Clearance Tooting will carry out the Services with reasonable care and skill. Where loss or damage occurs as a result of negligence, liability will be limited to the direct cost of repair or replacement, subject to the limitations set out in this clause.

10.2 Waste Clearance Tooting will not be liable for any indirect, consequential or economic loss, including loss of profit, loss of business, loss of opportunity or loss of goodwill, whether arising in contract, tort or otherwise.

10.3 While reasonable care is taken when carrying items through buildings or over property, minor scuffs or marks may occur, especially in confined spaces. The Customer should remove or protect any items of particular value or sensitivity in areas where the crew will be working. Waste Clearance Tooting will not be liable for pre-existing damage or for damage arising from inadequate protection or preparation by the Customer.

10.4 Waste Clearance Tooting will not be liable for any delay or failure to perform the Services due to events beyond its reasonable control, including severe weather, road closures, accidents, vehicle breakdowns, strikes or other industrial disputes, or acts of public authorities.

10.5 Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.

11. Complaints

11.1 If the Customer is dissatisfied with any aspect of the Services, they should contact Waste Clearance Tooting as soon as possible, providing details of the issue and any supporting information.

11.2 Waste Clearance Tooting will investigate complaints promptly and aim to provide a response within a reasonable time. Where a complaint is found to be justified, Waste Clearance Tooting may, at its discretion, offer a remedy such as a partial refund, a corrective visit or an alternative solution.

12. Personal Data

12.1 Waste Clearance Tooting may collect and process personal data relating to the Customer for the purpose of administering bookings, providing Services, processing payments and handling enquiries or complaints.

12.2 Personal data will be handled in accordance with applicable data protection laws. The Customer is responsible for ensuring that any personal data they provide is accurate and up to date.

13. Termination

13.1 Either party may terminate the Agreement with immediate effect if the other party commits a material breach of these Terms and Conditions and, where the breach is capable of remedy, fails to remedy it within a reasonable period after being requested to do so.

13.2 Waste Clearance Tooting may suspend or terminate Services to a Customer who engages in abusive, threatening or unlawful behaviour towards its staff or contractors, or who persistently fails to comply with these Terms and Conditions.

14. Variations to Terms

14.1 Waste Clearance Tooting reserves the right to amend these Terms and Conditions from time to time. Updated terms will apply to new bookings from the date of publication or notification.

14.2 For ongoing commercial arrangements, Waste Clearance Tooting will take reasonable steps to inform Customers of significant changes. Continued use of the Services after notification will constitute acceptance of the revised Terms and Conditions.

15. Severability

15.1 If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, that provision will be deemed deleted, and the remaining provisions will continue in full force and effect.

16. Governing Law and Jurisdiction

16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services provided, shall be governed by and construed in accordance with the laws of England and Wales.

16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the provision of Services by Waste Clearance Tooting.

17. Entire Agreement

17.1 These Terms and Conditions, together with any specific terms agreed in writing in the booking confirmation, constitute the entire agreement between the Customer and Waste Clearance Tooting and supersede any previous understanding, arrangement or representation, whether written or oral, relating to the subject matter.

By placing a booking with Waste Clearance Tooting, the Customer confirms that they have read, understood and agree to these Terms and Conditions.
